The Carinthia University of Applied Science (CUAS) (DE: Fachhochschule Kärnten) offers users
the web portal under the following conditions:
Acceptance of Terms
(a)
By accessing and using this website, you agree to comply with these Terms of Use. If you do not agree
with these terms, please refrain from using the website.
Liability
(a)
The presented website is still in its prototype stage. We cannot guarantee the service to be available
at all times. The access to the website and the content can be lost at any time. CUAS accepts no
liability in the event of failure or unavailability of the website or its content. The accuracy of the
content of the website cannot be guaranteed either, so that no liability can be accepted.
User Registration
(a)
Users are responsible for providing accurate and up-to-date information during the registration process.
(b)
The website reserves the right to refuse or terminate user accounts for any violation of these terms
or inappropriate behavior at its discretion.
(c)
Users have the right to terminate their own accounts at any time. An option to do so is available in
the account settings. Upon termination, all associated data and content will be permanently deleted.
Purpose of the MoniConfig
(a)
The MoniConfig part of the website https://biomonitec.mca.tools/
allows registered users to fill out, save, copy, and manage multiple monitoring concept
worksheets as well as link e-tools from the e-tool kit to the worksheets, taking into account the
rights of use according to point “Intellectual Property”.
(b)
There is no community function or option to share content with others on the website.
(c)
While users are encouraged to utilize the website's toolkit, any contributions or additions to the
toolkit are to be coordinated directly with the website administrators. Users interested in
contributing to the toolkit are encouraged to contact us directly for further information and
collaboration opportunities.
Purpose of the IPAM Toolbox
(a)
The website https://ipam.mca.tools/ allows
registered users to fill out, save, copy, and manage multiple site self-assessments as well as
printing the reports.
(b)
There is no community function or option to share content with others on the website.
Intellectual Property
(a)
The website or the authors of the individual works made available remain the owners of the content,
including text, images, and user-generated content. All non-original content from third parties,
used on the website, will be properly cited. Users are required to respect the intellectual property
rights of third parties and adhere to any additional terms or conditions imposed by the original
content creators.
(b)
Users are strictly prohibited from using, reproducing, or distributing any content or property of
the website for commercial purposes without obtaining explicit written permission.
(c)
If Users contribute, upload or otherwise submit content to be published on the website, User grants
CUAS the non-exclusive, perpetual, worldwide, irrevocable right to use the content for publication
on the website free of charge, and to use it for commercial purposes, including to transfer it with
the rights to the platform. Users waive their right to be named as authors or copyright holders.
Users must ensure that all content is free of rights from third parties (including but not limited
to privacy and IP) and will hold CUAS harmless of any claims from third parties.
Termination of user accounts
(a)
In the event of violations of these Terms of Use, in particular of the copyrights or rights of use
in accordance with the above-mentioned general conditions, but also in the event of violations of
statutory provisions or common decency, CUAS is entitled to delete the user account and to prohibit
the use of the website.
(b)
In addition, CUAS reserves the right to take further legal action such as the assertion of claims
for damages.
Limitation of Liability
(a)
CUAS makes every effort to ensure that all content on the website is correct and up to date. All
texts on the website have been carefully checked. Nevertheless, no guarantee can be given for the
correctness, completeness and topicality of the information. Liability on the part of CUAS is
therefore excluded. The links to other websites have been carefully selected. As CUAS has no
influence on their content, CUAS accepts no responsibility for them. Furthermore, CUAS is not
liable for unauthorized advertising of its offers.
Governing Law
(a)
Austrian law shall apply to the exclusion of the conflict of laws rules.

Privacy Policy
(a)
In our privacy policy, we inform you in full about the use of your personal data within the scope
of our website. Biomonitec.mca.tools is a website operated by FH Kärnten – gemeinnützige Gesellschaft mbH.
(b)
No personal data is required to use the publicly accessible areas of our website (i.e., without
logging in). However, our web server still collects the data that your internet browser provides
us with (including the name of the page or file accessed, date and time, internet browser used,
the page from which you accessed our website, screen resolution, and operating system).
(c)
It is not possible to draw any conclusions about your person from this data. We collect data about
your use of our website via the provider listed below in the "Web analysis" section in order to
tailor it to your interests as best as possible.
(d)
Please also note that videos from the provider YouTube LLC, 901 Cherry Avenue, San Bruno,
CA 94066, USA, are embedded in our website. When you call up a page with an embedded video,
your IP address may be processed by YouTube LLC and cookies may be set. The YouTube privacy
policy applies here, which you can view at https://www.youtube.at/t/privacy.
Data Security
(a)
Biomonitec.mca.tools implements measures to ensure data security in accordance with Articles 25 and
32 of the GDPR. We have set extensive security measures to protect your data from unauthorized
access by third parties.
(b)
In this sense, the following measures, among others, are taken to protect your data and secure it
against loss, destruction, access, modification, and dissemination by unauthorized persons:
- Ensuring the confidentiality, integrity, availability, and resilience of the systems and services involved in processing;
- Ensuring rapid recovery of the data availability in the event of a physical or technical incident;
- Implementing procedures to regularly review, assess, and evaluate the effectiveness of technical and organizational measures to ensure the security of data being processed.
Use of the Platform
You must register to create inputs or access full extent of the information on the platform.
To enable you to access the platform, you must provide a username, password, and email address.
Purpose of processing and storage period
The data you provide will be used to enable you to access the platform. Your personal data will
be stored in accordance with the applicable legal provisions and retention obligations. Once you
delete your account, your personal data will be deleted, unless this conflicts with legal provisions
or retention obligations. The following personal data is processed:
- Username: first and last name, if applicable
- Password
- Email address
- Your contributions
Legal basis
The processing of personal data based on your request is a pre-contractual measure within the
meaning of Art. 6 (1) (b) GDPR. Without disclosing your data, you will not be able to access
the platform and create posts.
Recipients of data and data transfer to a third country
External recipients will only receive your data if this is necessary in individual cases to fulfill
the purpose. For example, other participants on the platform can see your contributions.
Processors employed by us may also process data on our behalf for the purposes described above if
they offer sufficient guarantees for the security of the data (e.g., cloud services, IT service
providers, printing companies, newsletter or mailings).
Microsoft 365
We use Microsoft 365 for our internal and external communication. Microsoft 365 is a Microsoft
product that is operated in the Microsoft Cloud. Due to the processing of personal data on our
behalf, the Microsoft Cloud is a processor in accordance with Art. 4 Z8 GDPR. A prerequisite for
permissible processing is a processor agreement in accordance with Art. 28 GDPR. Microsoft stipulates
in its data processing agreements that the processing of personal data takes place in principle within
the EU, but Microsoft reserves the right to process data in third countries or for its own purposes.
We base the permissibility of use on the standard contractual clauses concluded between us and Microsoft
in accordance with Art. 46 GDPR.
Automated decisions, profiling
No automated decision-making, including profiling, takes place.

RIGHTS OF DATA SUBJECTS
As a data subject, you have the following rights:
Right of access (Art. 15 GDPR)
You have the right to request information about whether we process your personal data. If this is
the case, you have the right to obtain information about this personal data and other information
related to the processing.
Right to rectification (Art. 16 GDPR)
If the personal data we process about you is no longer accurate or is incomplete, you can request that it be corrected and, if necessary, completed.
Right to erasure (Art. 17 GDPR)
If the legal requirements are met, you have the right to request the erasure of your personal data.
Right to restriction of processing (Art. 18 GDPR)
In the cases specified in Art. 18 GDPR (e.g., you dispute the accuracy of the personal data or the
processing is unlawful), you have the right to request the restriction of processing.
Right to data portability (Art. 20 GDPR)
If the legal requirements are met, you can request the transfer of your data in a structured,
commonly used, and machine-readable format.
Right to object to unreasonable data processing (Art. 21 GDPR)
For reasons arising from your particular situation, you may object at any time to the processing of
data concerning you that we process on the basis of a legitimate interest pursuant to Art. 6 (1) (f) GDPR.
Right to withdraw consent (Art. 7 GDPR)
If processing is based on a declaration of consent, you have the option of withdrawing this consent
at any time without affecting the lawfulness of the processing carried out on the basis of the
consent until withdrawal.
Measures in connection with automated decisions in individual cases,
including profiling (Art. 22 GDPR)
No automated decision-making, including profiling, takes place.
